Deschutes County is in Oregon's 11th Judicial District. The main trial court is Deschutes County Circuit Court, not a district court. Circuit Court handles criminal, civil, family, probate, juvenile, and other state trial-court matters. The Oregon Court of Appeals and Oregon Supreme Court handle appellate review. The Oregon Tax Court is a separate statewide specialty court.

Local lower courts are not part of the state-funded Oregon Judicial Department system. Deschutes County Justice Court is county administered and handles traffic and ordinance violations, small claims, and certain civil matters. Bend Municipal Court handles Bend city code, traffic, parking, and local violations. Where Deschutes County Records Live

Record custody is split in Deschutes County. Circuit Court case files belong with the Oregon Judicial Department through the local court. County administrative, marriage, recording, archive, and elections records belong with the Deschutes County Clerk. Sheriff custody, booking, law enforcement, and jail service records belong with the Sheriff's Office. District Attorney records are handled by the DA, and public defense records are not public court records.

Using the correct custodian avoids wasted searches. Divorce, custody, conviction, probate, and civil case files should be directed to Circuit Court. Official Records, deed indexes, plats, marriage licensing, archive material, and Commissioners' Journals go to the County Clerk. Current custody status goes to the Adult Jail roster, and state-prison status goes to Oregon DOC.

Types of Deschutes County Court Records

Deschutes County court records include civil, criminal, family, probate, juvenile, mental health, traffic, violation, warrant, and protective-order matters. Civil records can show complaints, answers, motions, judgments, writs, garnishments, and appeals. Criminal records can show charges, arraignment, pleas, hearings, motions, trial events, dispositions, sentences, probation conditions, fines, fees, and restitution.

Family and probate records need careful routing. Divorce and custody files are Circuit Court records, while marriage licenses are County Clerk records. Probate matters, including estates, guardianships, conservatorships, and trusts, are filed in the Probate Division of the Circuit Court. Some adoption, juvenile, mental health, and safety-related matters are restricted even when a related public case exists.

  • Criminal records: felony and misdemeanor files in Circuit Court, with DA filings and court dispositions.
  • Civil records: lawsuits, small claims by venue, landlord-tenant matters, judgments, and collection events.
  • Family records: dissolution, custody, support, parenting time, and protective-order matters with access limits.
  • Probate records: estates, wills, guardianships, conservatorships, trust matters, and fiduciary filings.
  • Traffic records: Circuit Court, Justice Court, or Bend Municipal Court records, based on the citation.

What Deschutes County Court Records Show

A Deschutes County court record can show the case number, case title, filing date, parties, attorneys, event dates, hearings, notices, judgments, dispositions, sentence terms, payment status, warrants, and document activity. OJD describes the register as a log of filings and events, not a full copy of every document. For many uses, that register is enough to confirm the existence and status of a case. For legal proof, a copy or certified copy may be required.

Deschutes County Public Access Laws

Oregon public access starts with the rule that public records are open unless an exemption applies. ORS 192.314 gives the general right to inspect public records. ORS 192.324 permits public bodies to recover reasonable actual costs. ORS 192.329 sets response timing, and Deschutes County applies this by acknowledging written county requests within five business days. Court registers are also governed by ORS 7.020.

Key Statutes:

ORS 192.314 gives access to public records unless an exemption applies.

ORS 192.324 allows reasonable cost recovery for public records work.

ORS 7.020 governs the court register of actions for filings and events.

ORS 137.225 is Oregon's set-aside law for eligible arrest, charge, and conviction records.

OJD copy fees from the research file are $0.25 per page for routine photocopies and $5 per certification plus per-page fees. OJD and Deschutes County both use a $25 estimate threshold language before staff continue work likely to exceed that amount.

Restricted Deschutes County Records

Not every record is public online. OJD states that adoption, juvenile, mental health, and Violence Against Women Act matters may be excluded from free records and calendars. Sealed and set-aside criminal records are restricted according to court order and Oregon law. Sheriff's records can also withhold or redact body camera material, medical details, ongoing investigation records, personnel investigations, and concealed handgun license information.

A restricted record may still exist even when it does not appear in a free search. Parties, attorneys, agencies, or people with court orders may have access that the general public does not. If a Deschutes County record search returns no result, check whether the record type is confidential, whether the case belongs to a different court, and whether a written request to the correct custodian is required.

Deschutes County Sheriff and Jail Records

The Deschutes County Sheriff's Office is at 63333 West Hwy 20 in Bend. The sheriff site lists Non-Emergency Dispatch at 541-693-6911 and Jail Info at 541-388-6661. The current sheriff listed in official source material is Sheriff Ty Rupert. The Adult Jail was built in 1994, expanded in 2014, and has a listed capacity of 362 beds.

The current inmate list is the official county jail roster for people in custody. It is updated continuously and shows public information such as inmate name, offense information, and current custody status. It covers people held for the Sheriff's Office, Bend Police Department, Redmond Police Department, Sisters Police Department, and other agencies operating in the county. State-prison inmates are searched through Oregon DOC, not the county jail.

The sheriff home page is the top official agency source for Deschutes County jail and law enforcement routing.

Deschutes Warrants and Traffic Tickets

Warrant information has a strict local limit. The sheriff's turning-yourself-in page says a person who believes they are wanted should report in person to the Adult Jail and should not call for warrant information because the sheriff cannot give warrant status by phone. During business hours, report to the jail lobby. After hours, report to the Inmate Service door at the front of the jail.

Traffic records are split by issuing court. Justice Court says a driver's license is the easiest way to search, and citation-number searches require adding year digits to the front. For DCSO eCites beginning with DC, drop DC and add the year digits plus 43 or 00 before the remaining number. Bend Municipal Court has its own online payment portal and tells users to call 541-388-5572 option 9 if a citation search fails.

Marriage Divorce Probate Records

Marriage licenses are issued by the Deschutes County Clerk at the Deschutes Services Building, not by Circuit Court. Applicants complete the online marriage application, then both parties visit the office together to review, sign, and buy the license. The license has a three-day waiting period, is valid only in Oregon, and expires 60 days from the effective date. Certified marriage copies can be ordered online or by mail.

Divorce records are Circuit Court records. The county public records page tells users to contact Circuit Court for divorce, custody, and conviction records. Probate is also filed in Circuit Court, through the Probate Division of the Circuit Court. Probate files can include estates, wills, guardianships, conservatorships, trusts, petitions, letters, notices, inventories, accountings, and orders.

Probate
The court process for estates, wills, guardianships, conservatorships, and related fiduciary matters.
Personal representative
The person appointed to handle an estate after court approval.
Guardian
A person appointed to make care or personal decisions for a protected person.
Conservator
A person appointed to manage finances for a protected person.

Deschutes County Court History

The current courthouse was built in 1978. The county court footprint is changing because OJD appointed two additional judges to the Bend circuit court in 2022. The expansion project began after board approval and programming work in 2022 and 2023, with construction and remodeling running through 2024 to summer 2026. The county lists a total project cost of $46.8 million.

Deschutes County legal records go beyond modern court systems. The County Clerk records research page lists deed records from 1871 to 1982, Official Records from 1983 to present, Commissioners' Journals from 1916 to 1969, patent records from 1905 to 1917, Miscellaneous Book A from 1888 to 1910, and water-rights records from the 1900s to 1950s. Older legal and property research may therefore belong with the Clerk rather than Circuit Court.

The county courthouse expansion page documents the current public building project.
